With this Data Protection Declaration, we, the Swiss Association of Wealth Managers | SAM, inform you about the processing of personal data in connection with our services, including our corresponding vsv-asg.ch website (hereinafter the "Website").

Our services are subject to Swiss data protection law and any applicable foreign data protection law, in particular that of the European Union (EU). The EU recognizes that Switzerland has legislation that guarantees adequate data protection.

Special, supplementary or additional data protection declarations may exist for individual and additional offers and services.

1 Processing of personal data

1.1 Personal data is all information relating to an identified or identifiable person. A data subject is a person about whom personal data is processed. Processing includes any handling of personal data, regardless of the means and procedures used, in particular the storage, disclosure, procurement, deletion, storage, modification, destruction and use of personal data.

1.2 We process the personal data that is necessary in order to be able to provide the service permanently, securely and reliably (Art. 6 para. 1 let. b and f of the EU General Data Protection Regulation, GDPR). We also process the personal data that people disclose themselves when using the offer and website - for example when placing an order when contacting us or for a newsletter subscription. The disclosure of personal data that is not required is voluntary.

1.3 We always process personal data in accordance with the applicable data protection law, in particular the Federal Act on Data Protection (FADP). If the processing of personal data is necessary and there is no general legal basis for such processing, such as the necessity for the fulfillment of a contract, we obtain the consent of the person concerned (Art. 6 para. 1 let. a GDPR).

1.4 Every time you visit our website - as is standard when you access any website - we collect general data that is stored in server log files for each individual access. For each access, we record the respective date and time, the Internet Protocol (IP) address used, the operating systems and browsers used, including versions, the individual web pages accessed and the website from which the visitors came to our website (so-called referrer). We do not identify individuals with this general data. We need this general information in order to deliver the website, to keep it permanently functional and to be able to continuously improve it (Art. 6 para. 1 let. f GDPR). We process this general data anonymously and evaluate it statistically in order to guarantee data security for the website so that we can ensure the protection of personal data.

1.5 We only store personal data for as long as is necessary for the respective purpose or purposes.

1.6 We may have personal data processed with the help of third parties and by third parties - in each case also abroad. Such processors process personal data on our behalf and exclusively within the scope of this Data Protection Declaration.

1.7 We may disclose personal data to companies - including abroad - that are affiliated with us. We ensure that such companies process the personal data concerned exclusively within the scope of this Data Protection Declaration.

1.8 We do not disclose any personal data to third parties without the consent of the person concerned. Exceptions to this are legal obligations to disclose and disclosure to enforce our own legal claims and disclosure to protect such legitimate interests (Art. 6 para. 1 let. f GDPR).

1.9 The legal basis under the GDPR for the processing of personal data that is necessary to protect the vital interests of data subjects or other persons is, in particular, Art. 6 para. 1 let. d GDPR.

1.10 The legal basis in accordance with the GDPR for the processing of personal data that is necessary to safeguard our legitimate interests but is not covered by any other legal basis is Art. 6 para. 1 let. f GDPR, provided that no fundamental freedoms and rights or interests of the data subjects that require the protection of personal data prevail, in particular if the data subjects are children. When processing personal data in this context, our legitimate interest lies in ensuring our own business activities for the benefit of the general public, owners and employees.

2 Organizational and technical measures

2.1 We take appropriate and suitable organizational and technical measures to ensure data protection and data security. When personal data is processed abroad or by third parties, we ensure that appropriate data protection is guaranteed.

2.2 Despite organizational and technical measures, the processing of personal data on the Internet may in principle have security gaps, so that absolute data protection and absolute data security cannot be guaranteed. For this reason, every data subject is free to disclose personal data to us by other means, in particular by post.

2.3 The website is accessed using transport encryption (SSL / TLS).

2.4 Access to the Website - as is generally the case with all Internet use - is subject to mass surveillance without cause and without suspicion as well as other surveillance by security authorities in Switzerland, the EU, the United States of America (USA) and other countries. We have no influence on the processing of personal data by secret services, police departments and other security authorities.

3. Cookies and web beacons

3.1 We may use cookies and web beacons for the Website, including those of third parties. Cookies are, in particular, small text files that are stored on the end devices of visitors to the website, such as smartphones and other computers.

3.2 Cookies and web beacons are used - also in the case of third parties (third-party cookies) - to deliver the website, to keep it permanently functional and to be able to continuously improve it (Art. 6 (1) (b) and (f) GDPR). We also need cookies to be able to process orders (Art. 6 (1) (f) GDPR).

3.3 Cookies can be completely or partially deactivated and deleted at any time in the browser settings. Web beacons can be blocked at any time in the browser settings or with appropriate browser extensions. If cookies are completely or partially deactivated and tracking pixels are blocked, the offer may lose its user-friendliness or may no longer be able to be used to its full extent.

4. Third-party services

4.1 For the hosting of the website, we work together with INSOR AG in Switzerland. The relevant data in connection with our offer is stored in Switzerland. 4.2 Wir verwenden Google Fonts, ein Angebot der amerikanischen Google LLC (nachfolgend "Google"), um ausgewählte Schriftarten in die Website einbinden zu können (Art. 6 Abs. 1 Bst. f DSGVO). Google ist sowohl nach dem EU-amerikanischen als auch nach dem schweizerisch-amerikanischen Privacy Shield zertifiziert und gewährleistet dadurch einen angemessenen Datenschutz. 4.3 Wir verwenden Youtube, ein Angebot der amerikanischen Google LLC. (nachfolgend "Google"), um Videos auf der Webseite bereitszustellen (Art. 6 Abs. 1 Bst. b u. f DSGVO). Youtube hat insbesondere folgende Informationen zu Art, Umfang und Zweck der Datenbearbeitung veröffentlicht: Datenschutzerklärung.

5. Google Analytics

Diese Website benutzt Google Analytics, einen Webanalysedienst der Google Inc, (1600 Amphitheatre Parkway Mountain View, CA 94043, USA; "Google"). Die Nutzung umfasst die Betriebsart "Universal Analytics". Hierdurch ist es möglich, Daten, Sitzungen und Interaktionen über mehrere Geräte hinweg einer pseudonymen User-ID zuzuordnen und so die Aktivitäten eines Nutzers geräteübergreifend zu analysieren.

Google Analytics verwendet sog. "Cookies", Textdateien, die auf Ihrem Computer gespeichert werden und die eine Analyse der Benutzung der Website durch Sie ermöglichen. Die durch das Cookie erzeugten Informationen über Ihre Benutzung dieser Website werden in der Regel an einen Server von Google in den USA übertragen und dort gespeichert. Im Falle der Aktivierung der IP-Anonymisierung auf dieser Website, wird Ihre IP-Adresse von Google jedoch innerhalb von Mitgliedstaaten der Europäischen Union oder in anderen Vertragsstaaten des Abkommens über den Europäischen Wirtschaftsraum zuvor gekürzt. Nur in Ausnahmefällen wird die volle IP-Adresse an einen Server von Google in den USA übertragen und dort gekürzt. Die im Rahmen von Google Analytics von Ihrem Browser übermittelte IP-Adresse wird nicht mit anderen Daten von Google zusammengeführt. Im Auftrag des Betreibers dieser Website wird Google diese Informationen benutzen, um Ihre Nutzung der Website auszuwerten, um Reports über die Websiteaktivitäten zusammenzustellen und um weitere mit der Websitenutzung und der Internetnutzung verbundene Dienstleistungen gegenüber dem Websitebetreiber zu erbringen. In diesen Zwecken liegt auch unser berechtigtes Interesse an der Datenverarbeitung. Die Rechtsgrundlage für den Einsatz von Google Analytics ist § 15 Abs. 3 TMG bzw. Art. 6 Abs. 1 lit. f DSGVO. Die von uns gesendeten und mit Cookies, Nutzerkennungen (z. B. User-ID) oder Werbe-IDs verknüpften Daten werden nach 14 Monaten automatisch gelöscht. Die Löschung von Daten, deren Aufbewahrungsdauer erreicht ist, erfolgt automatisch einmal im Monat. 6. Rechte von betroffenen Personen

6.1 Personen, über die wir Personendaten bearbeiten, können unentgeltlich eine Bestätigung, ob Personendaten durch uns bearbeitet werden sowie, falls ja, Auskunft über unsere Bearbeitung ihrer Personendaten verlangen, die Bearbeitung ihrer Personendaten einschränken lassen, ihr Recht auf Datenübertragbarkeit wahrnehmen, ihre Personendaten berichtigen, löschen ("Recht auf Vergessenwerden") oder sperren lassen, erteilte Einwilligungen widerrufen und Widerspruch gegen die Bearbeitung ihrer Personendaten erheben.

6.2 Personen, über die wir Personendaten bearbeiten, verfügen über ein Beschwerderecht bei einer zuständigen Aufsichtsbehörde für den Datenschutz. Aufsichtsbehörde für den Datenschutz in der Schweiz ist der Eidgenössische Datenschutz- und Öffentlichkeitsbeauftragte (EDÖB).

6.3 Rechte, die betroffenen Personen gemäss schweizerischem Datenschutzrecht nicht zustehen, gewähren wir solchen Personen - sofern und soweit gemäss schweizerischem Recht zulässig - freiwillig, sofern und soweit das EU-Datenschutzrecht solche Rechte vorsieht.
